Washington, D.C. – September 16, 2025:
President Donald J. Trump has signed an executive order further delaying enforcement of the Protecting Americans from Foreign Adversary Controlled Applications Act as it applies to TikTok, extending the deadline to December 16, 2025.
The order directs the Department of Justice (DOJ) to take no enforcement action against TikTok or any other foreign adversary-controlled applications during this period. This includes refraining from imposing penalties for distributing, maintaining, or updating such apps.
Additionally, the Attorney General is instructed to issue formal guidance and letters to app providers confirming there is no liability for any actions taken during the delay period or prior to the issuance of the order.
President Trump emphasized that enforcement authority under the Act lies solely with the Attorney General and directed the DOJ to defend the Executive Branch’s exclusive power against any attempts by states or private parties to independently enforce the law.
The order clarifies that it does not create new legal rights or benefits for private parties and must be implemented in compliance with existing law and available appropriations.
This is the third extension of the TikTok enforcement delay since the Act was signed earlier this year, reflecting the administration’s continued cautious approach to restricting TikTok while national security and legal concerns are addressed.
