Washington, D.C. — August 25, 2025 — President Donald J. Trump signed an executive order Monday aimed at strengthening legal and immigration penalties for desecrating the American flag, calling the measure a step to “restore respect, pride, and sanctity” to the nation’s most cherished symbol.
The order instructs the Attorney General to aggressively prosecute violations involving flag desecration and to pursue legal challenges clarifying the limits of First Amendment protections in such cases. It also requires flag desecration cases that fall under state or local laws to be referred to the appropriate authorities.
Foreign nationals accused of burning or defiling the flag could face visa denials, revocations of immigration benefits, or removal from the United States under the new directive, coordinated by the Departments of State and Homeland Security.
Citing incidents of flag burning during violent protests in Los Angeles earlier this summer, the White House described flag desecration as “a uniquely offensive act” that undermines national unity and disrespects the sacrifices of U.S. service members.
Trump has repeatedly condemned flag burning, labeling it “disgraceful,” and has pushed policies designed to reinforce national pride. His administration has banned the display of flags other than the Stars and Stripes at State Department facilities, launched the America 250 Commission, and directed the Smithsonian Institution to ensure exhibits reflect “American exceptionalism.”
“The American flag represents all Americans of every background and walk of life,” the White House said. “Desecrating it is a statement of contempt and hostility toward our Nation.”
